QCAT awards financial compensation for breach of privacy

The Queensland Civil and Administrative Tribunal (QCAT) recently published a decision about a privacy complaint that concerned the disclosure of information about the employee’s health to a number of other employees in the agency.
QCAT found that a breach of Information Privacy Principle 10 – ‘Limits on use of personal information’ was substantiated and ordered that the Queensland Police Service:

On 14 February 2017 we tabled our report in Parliament about our review of the Gold Coast Hospital and Health Service’s compliance with the Right to Information Act 2009 (Qld) and the Information Privacy Act 2009 (Qld).
Media release: Moreton Bay Regional Council’s use of upgraded CCTV cameras with audio recording capability - 8 February 2017

Queensland’s Privacy Commissioner will be seeking clarification from Moreton Bay Regional Council about their use of CCTV cameras that record audio to determine Council’s compliance with the Information Privacy Act 2009 (Qld).
This follows Councils recent deployment of upgraded CCTV cameras. Council operate a network of 874 CCTV cameras throughout the Moreton Bay Region and over one third now have the capability to play back audio.

Review of the Right to Information Act 2009 and Information Privacy Act 2009

The Right to Information Act 2009 (RTI Act) and Information Privacy Act 2009 (IP Act) are an important part of Queensland Government’s integrity framework. The Acts aim to make more Queensland Government information available and ensure protection of an individual’s privacy in the public sector environment.
The purpose of this consultation is to seek feedback on key issues raised by the RTI and IP Acts including whether the Acts are meeting their primary objectives and whether the provisions of the Acts are appropriate.
