Information access requests to the Queensland Police Service

The Right to Information Act 2009 (RTI Act) and the Information Privacy Act 2009 (IP Act) deal with access to documents held by Queensland government agencies. Formal access applications under the RTI and IP Act should be made as a last resort only.

QPS administrative access schemes and Online Services

QPS administrative access schemes and Online Services make information available for purchase or by application to QPS or another agency that holds the information.1 For example, QPS has schemes in place for court briefs, police photographs, and criminal histories.

RTI and IP access applications

The RTI Act gives members of the public the right to apply for access documents held by Queensland government agencies and Ministers.  The IP Act gives an individual the right to apply to access and amend their own personal information held by government.

Accessing police investigation documents

Under the RTI and IP Acts you have the right to apply to access police documents. You do not have to give reasons for wanting to access the documents you are applying for, but in some cases doing so may help the agency make their decision.2

While you can apply for almost anything, you need to be aware that there are certain types of information you will not be given access to, for example the name of a person who made a complaint against you or anything that would reveal a confidential source of information. This is because this kind of information will be exempt or contrary to the public interest to release and the RTI Act allows the police to refuse you access to it.
