104 Protection of agency etc. from personal liability

(1) Neither—

(a) an agency, an agency’s principal officer or a Minister; nor

(b) a person acting under the direction of an agency, an agency’s principal officer or a Minister; incurs civil liability for an act or omission done or omitted to be done honestly and without negligence under, or for the purposes of, this Act.

(2) A liability that would, but for this section, attach to a body or person mentioned in subsection (1) attaches instead to the State.
