Application of Section 45 IP Act

A parent has the right to make an application on behalf of their child in relation to their child's personal information. For these applications, the child is the applicant, not the parent.

A child is an individual under 18 years of age. Parent includes a guardian exercising parental responsibility for the child under the Child Protection Act 1999 (Qld), but does not temporary parental replacements (eg a foster parent).
