Terms and Conditions for use of the OIC Agency Portal, for Queensland Government agencies.

1. Introduction

These Terms and Conditions govern the use of the Office of the Information Commissioner Queensland (OIC) Agency Portal (the "Portal") by Queensland Government agencies. By accessing or using the Portal, you agree to comply with these Terms and Conditions. If you do not agree, you must refrain from using the Portal.

2. Definitions

"Portal": The online platform provided by the Office of the Information Commissioner Queensland Agency Portal for agency use.

"User": Any individual or entity accessing the Portal on behalf of a Queensland Government agency.

"Agency": A Queensland Government department, statutory body, or other authorised entity.

3. Authorised use

3.1 The Portal is to be used solely for official purposes.

3.2 Users must ensure that all activities conducted via the Portal comply with applicable laws, regulations, Queensland Government policies and applicable codes of conduct included but not limited to the Queensland Government Code of Conduct or Local Government Code of Conduct.

3.3 Access is restricted to authorised personnel only. Sharing login credentials or granting unauthorised access is strictly prohibited.

4. User responsibilities

4.1 Users must ensure that all information entered into the Portal is accurate, complete and up-to-date.

4.2 Users are responsible for maintaining the confidentiality of their login credentials.

4.3 Users must immediately report any unauthorised access, suspected security breaches, or misuse of the Portal to the OIC IT support team.

5. Prohibited activities

Users must not:

5.1 Use the Portal for personal, commercial or non-governmental purposes.

5.2 Upload, share, or distribute any content that is unlawful, defamatory, or infringes on intellectual property rights.

5.3 Attempt to bypass security measures, introduce malicious software, or engage in any activity that compromises the Portal's integrity.

6. Privacy and data protection

6.1 The Portal collects and processes data in accordance with the Information Privacy Act 2009 (Qld).

6.2 Users must ensure that any personal information entered into the Portal is handled in compliance with Queensland Government privacy principles.

6.3 Agencies are responsible for ensuring that their use of the Portal aligns with their obligations under the Public Records Act 2023 (Qld).

6.4 We will collect, use and disclose your personal information and personal information contained in documents uploaded to the portal in accordance with our Privacy Policy.

7. Intellectual property

7.1 All content, software, and materials provided through the Portal remain the property of the OIC or its licensors.

7.2 Users are granted a non-exclusive, revocable licence to use the Portal for authorised purposes only.

8. Security

8.1 The OIC employs robust security measures to protect the Portal. However, users must take reasonable precautions to safeguard their access credentials and devices.

8.2 Users must not engage in activities that compromise the security of the Portal or its data.

9. Suspension or termination of access

9.1 The OIC reserves the right to suspend or terminate access to the Portal at its discretion, including but not limited to cases of non-compliance with these Terms and Conditions or applicable codes of conduct included but not limited to the Queensland Government Code of Conduct or Local Government Code of Conduct.

9.2 Agencies will be notified of any suspension or termination and provided with reasons where appropriate.

10. Limitation of liability

10.1 The OIC is not liable for any loss or damage arising from the use of, or inability to use, the Portal.

10.2 Users acknowledge that the Portal may be subject to downtime, errors, or interruptions, and the OIC does not guarantee uninterrupted access.

11. Amendments

11.1 These Terms and Conditions may be updated from time to time. Users will be notified of significant changes and continued use of the Portal constitutes acceptance of the updated terms.

12. Governing law

These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising from the use of the Portal will be subject to the exclusive jurisdiction of the courts of Queensland.

13. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable for any reason, that provision will be severed from the Terms and Conditions, and the remaining provisions will continue to apply in full force and effect.
