Application of Schedule 3, section 10(1)(a) RTI Act

When applying this exempt information provision, the following will be relevant:

1. Does the information consist of the type of information listed in schedule 3, section 10(2)?
2. Is there an investigation into a contravention or possible contravention of the law? This does not need to be the criminal law.
3. Is the investigation currently ongoing? If the investigation has been finalised, it is highly unlikely that this section will apply.
4. Is it reasonable to expect that disclosing the information could prejudice the investigation?
