Overview of section 68(4)(c) RTI Act

Section summary

If providing access in the form requested by an applicant would infringe the copyright of a person other than the State, an agency or Minister may refuse access in that form and grant access in another form. 

Background 

This section replicates section 30(3)(c) of the repealed FOI Act with no substantive changes.

A decision to provide access in a form different to the form requested by the applicant is a reviewable decision under schedule 6 of the RTI Act, unless access in the form applied for would infringe the copyright of a person other than the State.
