Overview of sections 47(3)(f) and 53 RTI Act

Section summary

Access may be refused to a document which is otherwise available in accordance with the requirements set out in section 53 of the RTI Act.

Background

This ground of refusal is substantially the same as section 22 of the repealed FOI Act however section 53 of the RTI Act extends the ground of refusal to commercially available documents.

This ground of refusal is designed to ensure that more specialised access schemes are not overridden by general information access legislation.1
