Application of section 29 RTI Act

There is no general requirement to search backup systems, however an agency can if it considers the search would be appropriate.

An obligation to search backup systems may arise if an agency is going to make a decision to refuse access on the grounds that documents do not exist or are unlocatable under section 52 of the RTI Act.
