Schedule 1 RTI Act
Schedule 1 of the RTI Act lists documents that are not subject to the RTI Act. The list includes:

  • particular intelligence agency documents and documents containing a summary or extract of an intelligence agency document, to the extent of that extract or summary
  • documents created or received in carrying out activities under the Terrorism (Preventative Detention) Act 2005 (Qld)
  • particular documents under of the Crime and Corruption Act 2001 (Qld)
  • particular documents under certain provisions the Police Powers and Responsibilities Act 2000 (Qld)
  • particular documents created under the Police Service Administration Act 1990 (Qld)
  • particular documents created or received by the Queensland Integrity Commissioner for the Integrity Act 2009 (Qld)
  • document created or received by the Prostitution Licensing Authority for the Prostitution Act 1999 (Qld)
  • particular coronial documents while a coroner is investigating the relevant death
  • a document created for a root cause analysis of a reportable event under the Ambulance Service Act 1991 (Qld) or Hospital and Health Boards Act 2011 (Qld)

Section 32(1)(b)(i) RTI Act
An entity may decide that an application is outside the scope of the RTI Act if the document sought is a document to which the Act does not apply under section 11 and schedule 1 of the RTI Act.

Section 32(2) RTI Act
This provision states that the entity must give prescribed written notice to the applicant of the decision that the application is outside the scope of the act within 10 business days after the purported application is received.
