Relevance to the RTI Act

Schedule 4, part 4 of the RTI Act lists factors favouring nondisclosure in the public interest because of public interest harm in disclosure. Relevantly, section 46(1)(b) of the FOI Act is replicated by schedule 4, part 4, section 8 of the RTI Act as a public interest factor favouring nondisclosure because of the public interest harm in disclosure, rather than a ground for exemption.

Schedule 4, part 3, item 16 of the RTI Act lists as a factor favouring nondisclosure in the public interest, information the disclosure of which could reasonably be expected to prejudice an agency's ability to obtain confidential information.
