In this 'reverse FOI' case, the matter in issue comprised one paragraph of a facsimile transmission sent by the applicant to the respondent concerning a tender for construction of a truck wheel wash device. The applicant claimed that the matter in issue comprised exempt matter under s.45(1)(c) of the FOI Act.
The Information Commissioner was not satisfied that disclosure of the matter in issue could reasonably be expected to have an adverse effect on the business, commercial or financial affairs of the applicant or any other person, or to prejudice the future supply of like information to government.
