In 1997, a complaint was made to the Council concerning breaches of health regulations on property owned by the applicant, who sought access to details of the person who had made the complaint. The Information Commissioner applied principles established in McEniery and the Medical Board of Queensland (1994) 1 QAR 349 and Bussey and Council of the Shire of Bowen (1994) 1 QAR 530 in finding that the identity of the complainant was exempt matter under s.42(1)(b) of the FOI Act.
