The applicant sought, under s.73(1)(d) of the FOI Act, an extension of time in which to lodge an application for external review.
The Information Commissioner decided not to exercise the Commissioner's discretion under s.73(1)(d) to allow the applicant an extension of time, due to the extent of the unexplained delay by the applicant, and the Information Commissioner's view that, in any event, the matter in issue qualified for exemption under s.44(1) and s.46(1) of the FOI Act.
