The Information Commissioner considered the application of s.43(1) of the FOI Act and the principles of legal professional privilege (including the head of 'common interest privilege') in deciding that it was clear, on the face of each of the documents in issue, that the sole purpose of its creation was one of the qualifying purposes for attracting legal professional privilege in Australian common law, and that each therefore qualified for exemption under s.43(1).
