Identity of complainant – s.42(1)(b) 

The applicant sought access to a letter containing information that would disclose the identity of its author.  The letter related to alleged breaches of the law. 

Applying the principles stated in McEniery and Medical Board of Queensland (1994) 1 QAR 349, Commissioner Taylor decided that the author was a confidential source of information, that the information communicated by the author related to the enforcement or administration of the law, and that disclosure of the matter in issue would enable the applicant to ascertain the identity of the author.  Commissioner Taylor therefore found that the letter was exempt under s.42(1)(b) of the FOI Act.
