Section 43(1) – Legal Professional Privilege 

The applicant sought access to a letter from Crown Law to the Department. 

Assistant Commissioner Henry affirmed the Department’s internal review decision and found that legal professional privilege attached to all of the matter in issue.  AC Henry was satisfied that the matter in issue was created for the dominant purpose of providing legal advice to the Department.
