Stewart and Queensland Police Service

The matter in issue related to the investigation of complaints made to the Queensland Police Service and the Criminal Justice Commission.  The Information Commissioner advised Mr Stewart that some of the matter had no relevance to him as it related to completely separate police administrative and investigative matters.  Mr Stewart did not pursue access to that matter. 

Applying the principles stated in Stewart and Department of Transport (1993) 1 QAR 227, Byrne and Gold Coast City Council (1994) 1 QAR 477 and Godwin and Queensland Police Service (1997) 4 QAR 70, the Information Commissioner found that all matter remaining in issue was exempt under s.44(1), as it concerned the personal affairs of persons other than Mr Stewart, and that the public interest considerations favouring disclosure did not outweigh the public interest in the protection of the privacy of those individuals.
