Sufficiency of search

The applicant sought access to documents relating to two breaches and one incident in which he was involved in a corrective services facility. Pursuant to the initial decision of Queensland Corrective Services (QCS), a number of documents were released to the applicant with respect to the breaches and incident in question.  On external review, the applicant raised issue with the sufficiency of the searches conducted by QCS, claiming that further documents responsive to the terms of his application should exist.

Following analysis of the QCS reporting procedures in place at the time of the breaches and incident in question, Assistant Commissioner Corby found that there were no reasonable grounds to believe that further documents relating to the breaches and incident were in the possession and under the control of QCS and that the searches undertaken by QCS were reasonable in the circumstances of this review.
