The Information Commissioner determined that the provisions of the Mental Health Act 1974 Qld relating to the issue of warrants for removal of persons to places of safety in the interests of the subject of the warrant, or for the protection of other persons, constitute a 'system for the protection of persons' within the terms of s.42(1)(h) of the FOI Act. The Information Commissioner also found that disclosure of information supplied by third parties in support of the issue of the warrant could reasonably be expected to prejudice that system, because it might unduly inhibit members of the community from volunteering like information in the future.
