Sufficiency of search

The applicant sought access to documents relating to his employment with the respondent.  The applicant raised a 'sufficiency of search' issue regarding the existence of documents. 

Assistant Commissioner Moss was satisfied that there were reasonable grounds for believing that the documents to which the applicant requested access exist (or at one time existed) in the possession, or under the control, of the respondent.  However, AC Moss was satisfied that the searches and inquiries which the respondent undertook in an effort to locate the requested documents were reasonable in all the circumstances of the case.
