The Deputy Information Commissioner decided that documents which recorded communications between the respondent and its solicitors concerning the way in which the respondent should respond to complaints and a grievance lodged by the applicant, qualified for exemption under s.43(1) of the FOI Act.  He decided that disclosure by the respondent of other non-privileged information did not constitute waiver of privilege in the matter in issue.  He also decided that the applicant had not demonstrated a prima facie case that the relevant communications were made in furtherance of an illegal or improper purpose.
