Application number:

Decision date:
Wednesday, Nov 08, 2000

Moon and Gold Coast District Health Service (Department of Health)
(2000 S0182, 8 November 2000)

The applicant was a registered nurse who sought access to all documents relating to an incident which occurred in the Gold Coast Hospital's maternity ward in March 2000.

The Health Service requested an application fee of $31 on the basis that the documents in issue concerned the applicant's employment affairs and not her personal affairs (the applicant was on duty in the maternity ward at the time).

The Information Commissioner had previously decided that it is only necessary for an applicant to seek access to one document which contains no information which can properly be characterised as information concerning the applicant's personal affairs, in order for the application to attract a fee. After examining a sample of the documents in issue, the Information Commissioner affirmed the Health Service's decision that an application fee of $31 was payable.
