The applicant sought access to information concerning medical treatment given to his late brother who had been a patient at Wolston Park Hospital at the time of his suicide in June 1992. 

Assistant Commissioner Moss found that the matter in issue concerned the personal affairs of the applicant's late brother.  AC Moss applied Summers and Cairns District Health Services; Hintz (Third party) (1997) 3 QAR 479 in finding that the applicant's reasons for seeking access to the matter in issue -  in order to come to terms with his brother's death and to assist in his rehabilitation from drug addiction, could not properly be characterised as public interest considerations, but rather, were personal interests of the applicant.  Consequently, she decided that the matter in issue was exempt from disclosure under s.44(1) of the FOI Act.
