This review concerned the application of s.44(1) of the FOI Act. The applicant sought access to documents (audio-taped interviews) relating to an investigation by the respondent involving third parties.
The Information Commissioner found that the matter in issue concerned the personal affairs of the third parties, in particular the mention of their names in police records, in connection with some alleged wrongdoing. The Information Commissioner was unable to identify public interest considerations weighing in favour of disclosure of the matter in issue, sufficient to outweigh the public interest in protecting the privacy of the persons referred to.
