The applicants sought access to information held by the respondent which would identify the person(s) (who will be referred to as the ‘third party’) who had trapped the applicant's cat and delivered it to the respondent. 

The respondent subsequently destroyed the cat.  Applying the principles stated in Stewart and Department of Transport (1993) 1 QAR 227, the Information Commissioner decided that the third party's actions in obtaining the trap from the respondent and trapping the cat, were the third party's personal affairs. 

The Information Commissioner therefore found that the matter in issue was prima facie exempt under s.44(1) of the FOI Act.  The Information Commissioner was not satisfied that disclosure of the matter in issue would, on balance, be in the public interest, and therefore found it to be exempt matter under s.44(1) of the FOI Act.
