Henderson and Crime and Misconduct Commission
(2005 F0313, 19 January 2007)

Sufficiency of search

The applicant sought access to documents under the Freedom of Information Act 1992 (Qld) in relation to an audit he believed had been conducted by the CMC into the financial administration of the Queensland Law Society in approximately 2001 or 2002.

Applying the principles stated in Shepherd and Department of Housing, Local Government & Planning (1994) 1 QAR 464, AC Gittins found that there were no reasonable grounds to believe that such documents were in the possession or under the control of the CMC and that the searches conducted by the CMC were reasonable in the circumstances of the matter.
