The matter in issue was the name and telephone number of a person who had expressed concerns to the Department about the safety of a bus.  The Information Commissioner found that the matter in issue was exempt under s.42(1)(b).

The Information Commissioner found that there was a common implicit understanding that the complainant's identity was to be kept confidential, that the information communicated by the complainant related to the enforcement or administration of the law (the Motor Vehicle Safety Act 1980 and related Acts), and that disclosure of the matter in issue could be expected to identify the source.
