FREEDOM OF INFORMATION – section 54E of the Freedom of Information Act 1992 (Qld) – amendment of WorkCover Queensland file – whether information is inaccurate, incomplete, out-of-date or misleading – whether documents should be added to the file.
The applicant applied to amend her WorkCover Queensland (WorkCover) file on the basis that the file was incomplete as a number of documents were missing or had been destroyed.
During the course of the external review, the applicant provided copies of documents to be added to the file in order to make it complete. WorkCover agreed to amend the file by adding 27 of these documents to the applicant’s file. In respect of the remaining documents, Assistant Commissioner Henry found that the applicant had not provided sufficient evidence to demonstrate that the WorkCover file was inaccurate, incomplete, out-of-date or misleading for the purpose of section 54E of the Freedom of Information Act 1992 (Qld). Accordingly, Assistant Commissioner Henry declined to add the additional documents to the WorkCover file.
