The applicant sought review of the respondent's decision to refuse him access to documents which disclosed details of subjects studied and results obtained, by another person, in the course of studies for a graduate diploma awarded by the respondent and a degree awarded by another tertiary institution.
The Information Commissioner found that the matter in issue was exempt matter under s.44(1), and that any public interest considerations favouring disclosure of the matter in issue were not sufficiently strong to outweigh the public interest in non-disclosure which is inherent in the satisfaction of the test for prima facie exemption under s.44(1).
