The matter in issue comprised parts of a memorandum from one officer of the respondent to another, concerning an incident which occurred during a Court proceeding in which an officer of the respondent defended the applicant.
The Information Commissioner found that the matter in issue was exempt under s.44(1). The Information Commissioner decided that the matter concerned the personal affairs of the author notwithstanding that the document was brought into existence as a result of an incident which occurred during the course of the author's employment with the respondent. The Information Commissioner found that there were no public interest considerations of sufficient weight to overcome the public interest in protecting the privacy of the author.
