‘Sufficiency of search’

The applicant sought access to medical test results for his son, which he contended should exist in the possession or control of the Department.  He submitted that the Department had failed to locate numerous medical test results responsive to his FOI application.

Assistant Commissioner Corby found that there were no reasonable grounds for believing that medical test results (other than those already located and released to the applicant) existed in the possession or control of the Department.  Additionally, Assistant Commissioner Corby found that the searches and inquiries made by the Department in an effort to locate all documents in its possession or control that were responsive to the applicant’s application were reasonable in the circumstances of the case.
