RTI Squared

The term 'RTI squared' is commonly used to refer to an access application made for the processing file of a previous access application. A recent Office of the Information Commissioner decision, T71 and Queensland Police Service [2022] QICmr 10 (4 March 2022), has settled the question of RTI squared, applying the reasoning set out in Carmody v Information Commissioner & Ors (5) [2018] QCATA 18.

Application processing documents are accordingly excluded from the operation of the Acts. This applies to access applications under the Right to Information Act 2009 (Qld), access or amendment applications under the Information Privacy Act 2009 (Qld), and to internal review processing files.
