Section 85 of the RTI Act gives a person affected by certain decisions of a Minister or agency the right to apply for an external review regardless of whether there has been an internal review of the initial decision.
Section 73 of the (repealed) FOI Act outlines the procedure for applying for external review under that Act. It required an applicant to apply for internal review of a decision before they were entitled to apply for external review.
