Legal Professional Privilege

The Legal Professional Privilege three-part video series is designed for agency officers who make decisions under the Right to Information Act 2009 (Qld) (RTI Act) and the Information Privacy Act 2009 (Qld) (IP Act).

These training videos draw on material available on our website—in OIC’s information sheets, guidelines, Annotated Legislation and decisions—and builds on those resources, however it is not necessary to be familiar with this material prior to viewing the presentation. They cover the circumstances in which an agency can refuse access to information because it is exempt on the grounds of legal professional privilege, taking decision makers through the basics of what it is necessary to establish that information is privileged all the way through writing the decision to refuse access.  It also examines privilege in detail, both advice privilege and litigation privilege, the considerations to take into account when deciding if information is exempt, and the tools available on our website to assist decision makers.

The presentation is facilitated by a senior OIC officer with experience in interpreting and applying the legislation, and access application decision-making, and draws on agency and OIC experience.
