Application of sections 47(3)(c) and 50 RTI Act

Under the RTI Act, applications can be made by:

  • a child (ie an individual under 18 years old); and
  • a parent on behalf of a child.

Section 47(3)(c) and 50 of the RTI Act provide for refusal of access to the child's personal information in response to these applications if disclosure would not be in the best interests of the child.
