Overview of section 32 RTI Act

Section summary

An application for access to a document is outside the scope of the RTI Act if:

• the document sought is not a document to which the RTI Act applies 
• the entity to which the application is made is not an entity to which the RTI Act applies; or 
• the access application is made to the Information Commissioner, RTI Commissioner or Privacy Commissioner.

Section 11, schedule 1 RTI Act
Under section 11 of the RTI Act, a 'document to which this Act does not apply' means a document mentioned in schedule 1 of the RTI Act.

Section 17, schedule 2 RTI Act
Under section 17, an 'entity to which this Act does not apply' means an entity mentioned in schedule 2, part 1 or an entity mentioned in schedule 2, part 2 in relation to the entity's functions that are mentioned in that part.

Section 26 RTI Act
An access application may not be made or transferred to the Information Commissioner, RTI Commissioner or Privacy Commissioner.
