Application of section 32 RTI Act

This section sets out how entities must deal with purported applications outside the scope of the Act. A purported application will be outside the scope of the Act if it is:

  • for a document to which the Act does not apply, as set out in section 11 and schedule 1 of the Act
  • an entity to which the Act does not apply, either completely or in relation to a particular function, as set out in schedule 2 of the Act
  • made to the Information Commissioner, Right to Information Commissioner, or Privacy Commissioner.

Refer to Applications outside the scope of the Acts and Documents to which the RTI and IP Act do not apply for guidance on applying this section.
