Application of section 6 RTI Act

A valid RTI application overrides any other Act that prohibits the disclosure of information. However, the RTI Act specifically recognises:

• certain legislative provisions that prohibit information release by providing that the information is exempt from release under schedule 3, section 12; and
• that it may be contrary to the public interest to release information subject to legislative provisions that prohibit its release in the public interest factor against disclosure contained in schedule 4, part 3, item 22.
