Application of Section 101(1)(d) IP Act

An application for external review must be made to the Information Commissioner within 20 business days from the date of the written decision notice. Where a review is being sought of a deemed decision, an application for external review must be made within 20 business days of the date of the deemed decision notice or, if a notice is not issued, within a reasonable time of the applicant becoming aware of the deemed decision.

The Information Commissioner has the discretion to accept applications for external review received out of time.
