Relevance to the RTI Act

Schedule 4, part 4 of the RTI Act lists factors favouring nondisclosure in the public interest because of the public interest harm in disclosure.  Schedule 4, part 4, section 4 replicates part of section 41 of the repealed Freedom of Information Act 1992 (FOI Act) as a public interest harm factor rather than a ground for exemption.  Similarly, schedule 4, part 3 item 20 of the RTI Act replicates part of section 41 of the repealed FOI Act as a public interest factor favouring nondisclosure.
