Section 29A identifies procedural requirements that must be met before an agency or Minister may refuse to deal with an application under section 29(1) of the FOI Act.

The provision provides applicants an opportunity to alter their access application to remove the ground of refusal.

Section 29(1) FOI Act
Under section 29(1), an agency or Minister may refuse to deal with an application if they consider that processing the application would substantially and unreasonably:

  • divert the agency's resources from the performance of its functions; or
  • interfere with the Minister's performance of his or her functions.

Section 27 FOI Act
Section 27 identifies the 'appropriate period' an agency or Minister has for dealing with an access application. The 'appropriate period' may be affected by the operation of section 29A of the FOI Act.
