Relevance to the RTI Act

Schedule 4, part 3 of the RTI Act lists factors favouring nondisclosure in the public interest. Relevantly, schedule 4, part 3, item 10 of the RTI Act recognises as a public interest factor favouring nondisclosure, that disclosure of information could reasonably be expected to prejudice the 'security or good order' of a corrective services facility. Accordingly, consideration of the term 'security or good order' under section 11E of the FOI Act may provide guidance in considering the application of schedule 4, part 3, item 10 of the RTI Act.

Schedule 4, part 4 of the RTI Act lists factors favouring nondisclosure in the public interest because of public interest harm in disclosure. Relevantly, schedule 4, part 4, section 5 of the RTI Act recognises as a public interest factor favouring nondisclosure, disclosure of certain information brought into existence for ensuring security or good order of corrective services.
