The Information Privacy Act 2009 (Qld) (IP Act) recognises the importance of protecting the personal information of individuals.
The IP Act contains the privacy principles, which govern how Queensland government agencies collect, store, use and disclose personal information, and the mandatory notification of data breach scheme, which requires agencies to notify individuals and the Office of the Information Commissioner (OIC) of eligible data breaches.
If an individual believes an agency has not handled their personal information in compliance with the privacy principles, they can make a privacy complaint to the agency. If the agency isn’t able to resolve it to their satisfaction after 45 business days, they can bring their privacy complaint to the OIC.
