Important Notice about the State Penalties Enforcement Registry (SPER) Privacy Incident

On 9 May 2022, an incident occurred with the State Penalties Enforcement Registry (SPER) which caused Enforcement Notices containing people’s personal information to be sent out about unpaid fines to the wrong person. This error means a notice containing information about a debtor has been sent to another person, including their name, address, the amount owing, and the matters to which the fines relate.

If you received a notice which contains the personal information of another person, please respect that person’s privacy and destroy the notice.

If you have been affected by the SPER privacy incident of 9 May 2022, you should refer to SPER’s website for more information about the incident or contact SPER on 1300 365 635 or sper@treasury.qld.gov.au. SPER is writing to all affected individuals to inform them about the incident.

Affected individuals who believe that SPER has not handled the matter in accordance with their obligations under the Information Privacy Act 2009 (Qld) may make a privacy complaint directly to Queensland Treasury by email to privacy@treasury.qld.gov.au or by writing to SPER’s Privacy Contact Officer at GPO Box 611, Brisbane QLD 4001.

It is a requirement under the Information Privacy Act 2009 (Qld) to lodge a formal privacy complaint with SPER before the privacy complaint can be escalated to the Office of the Information Commissioner. If you lodge a privacy complaint with SPER, you should allow SPER at least 45 business days to deal with your complaint.  If you have not received an adequate response to your privacy complaint after 45 business days, you may lodge a privacy complaint with the Office of the Information Commissioner.
