The Right to Information Act 2009 (Qld) (RTI Act) and Information Privacy Act 2009 (Qld) (IP Act) give people the right to access documents, and amend personal information contained in documents, held by Queensland government agencies and Ministers (agencies), subject to the limitations in the Acts. The RTI and IP Act also give applicants and other people affected by a reviewable decision, such as a consulted third party, the right to apply for review.
The available review rights will vary based on the kind of decision and who made it, so it’s important to get the review rights right.
Agencies should review template letters, and decision makers should double check decision notices, to ensure they include the correct review rights, timeframes, and contact details.
OIC has noticed during external reviews that some agencies are including outdated contact details for the OIC in their decisions, which can negatively impact someone’s ability to apply for review. Application for external review can be lodged with the OIC as follows:
To assist agencies, the OIC has published two resources to assist in informing people of their review rights: the Review rights sample text, which can be pasted into decision notices, and the Explaining your review rights information sheet, which can be included with decision notices.
