In this 'reverse FOI' case, applying the principles set out in Cannon and Australian Quality Egg Farms Ltd (1994) 1 QAR 491 and B and Brisbane North Regional Health Authority(1994) 1 QAR 279, the Information Commissioner rejected the applicant's claim that certain matter concerning the transfer of a hotel licence was exempt under s.45(1) and s.46(1).

The Information Commissioner noted that much of the matter had already been made public in the course of applications to, and orders made by, the Licensing Court.  The Information Commissioner noted that the applicant had failed to demonstrate a basis for finding that any of the matter in issue was exempt.
