This case involved the application of s.44(1) and the principles set out in Byrne and Gold Coast City Council (1994) 1 QAR 477 to matter which would identify complainants to the Council regarding alleged breaches by the applicant of town planning laws.

 

In circumstances where the applicant had already been given access to the substance of all the complaints, the Information Commissioner found that there were no public interest considerations of sufficient weight to justify disclosure of matter which would identify the complainants, and decided that it was exempt matter under s.44(1) of the FOI Act.
