Clarification: Providing Evidence of Identity electronically
An agency has queried information provided on 8 January about verifying an applicant’s identity electronically. The Electronic Transactions (Queensland) Act 2001 generally supports the electronic provision of documents to facilitate the use of electronic transactions, which effectively removes unnecessary red tape. There are some exceptions to when the Electronic Transactions Act applies, and if an agency is unsure and needs to clarify whether such exceptions apply in their circumstances, legal advice can be sought.
However, we note that the Electronic Transactions Act does not limit the circumstances in which an agency can otherwise decide to accept a document electronically. It is a matter for each agency to carefully consider whether it is appropriate to accept identity documents electronically and apply security mechanisms appropriate to the circumstances, whether or not the Electronic Transactions Act applies.
The guideline Evidence of Authority and Identity has been amended to clarify the above.
