Chapter 5 of the Information Privacy Act 2009 provides for an indivdual to make a complaint about an agency's breach of the privacy principles which occurred on or after 1 December 2009. If the complaint is not resolved to the individual's satisfaction, and more than 45 business days has passed since the complaint was made, the individual can bring their complaint to the Office of the Information Commissioner. The Office of the Information Commissioner will handle the complaint in accordance with its Privacy Complaint Handling Policy (PDF, 99KB).
You may bring a privacy complaint to the Office of the Information Commissioner (OIC) about a breach of an agency’s (or its bound contracted service provider’s) obligation to comply with:
- the privacy principles
- the conditions of a public interest approval.
Please note complaints cannot be made about local government until 1 July 2010.
How do I bring my complaint to the OIC?
Before you complain, you should ensure that you have satisfied all of the requirements in our checklist (PDF, 141KB). If you are unsure, please contact the enquiry service on (07) 3234 7373.
Your complaint must be made in written form, either by:
- completing the electronic form on the OIC website (coming soon)
- completing a hard copy of the complaint form (DOC, 130KB), or detailing your complaint in a letter, and either hand delivering, posting, faxing or emailing it to the OIC office.

How do I make a privacy complaint about the OIC?
‘Agency’ includes the OIC. If you wish to complain that the OIC has failed to comply with the obligations above or if you wish to complain about the OIC’s service generally, please provide written details on your complaint to:
